Agreement to Terms & Conditions
This document constitutes a legal contract between MilitaryDate.com (herein referred to as "Provider") and the user who is enrolling for services (herein referred to as "User"). By checking the box on the signup form that notes "Agree to Site Terms & Conditions", you are accepting the conditions of this agreement as stated. Additionally, by acceptance of these these terms, you agree to receive occasional system status, membership and promotional notices from MilitaryDate.com via email (click for privacy policy).

Description of Service
Provider offers a dating service that allows registered members to place ads and contact other Users who have placed ads. Currently, there are two levels of service available to Users. "Registered" Users are not billed for service and may browse ads freely, as well as place their own ad. "Preferred" Users pay a recurring monthly subscription fee that allows them to contact an unlimited number of Users and send messages to them.

Availability of Service & Warranties
Provider shall make a good faith effort to provide services in a timely manner. However, the Provider and User both agree that the Internet is not controlled by any one entity and may be subject to delays and interruptions in service as such. From time to time, it may be necessary for the Provider to make site upgrades, changes and perform maintenance. These changes may result in the service becoming temporarily unavailable. Provider agrees to make a good faith effort to limit the length and frequency of these interruptions in service. The Provider offers no implied or stated warranties nor makes any guarantees to the quality and availability of service to the User.

Acceptable Use and Member Conduct
Users shall not participate in conduct deemed by Provider as inappropriate or deemed illegal by International/Federal/State/Local laws and regulations. This shall include posting content that is sexually graphic, racist or otherwise offensive in nature. Posting of commercial solicitations and/or other spam messages or offensive content to Users is also prohibited. Additionally, electronic stalking, harassment or other forms of abuse negatively affecting other Users will not be tolerated. Provider shall reserve the right to determine appropriate conduct where not dictated by laws & regulations. Provider reserves the right to edit ad content as posted by members to maintain compliance with this agreement.

Reporting Abuse by Other Members
In order to protect the privacy of our Users and to preserve a positive environment for our Users, it is imperative that any level of abuse by other Users of MilitaryDate.com be reported immediately. The preferred method of contact is to use our contact form. In doing so, please provide the username of the User who is in violation, the time of the incident and a description of the problem. Provider shall maintain sole authority over determining whether User abuse has taken place and maintain the right to determine appropriate action as deemed necessary.

Security
Provider shall make reasonable accommodations to provide for the security of User data and privacy. Provider and User agree that as security vulnerabilities are constantly being discovered in developing technology, it is impossible to make any guarantees with regard to the security and/or privacy of user information.

Violation of Terms of Service
Users found in violation of the Site Terms of Service shall be subject to having their account immediately terminated. Preferred membership fees paid by offending Users will not be credited for remaining service time.

Privacy Policy
We do not engage in the reselling of our members names, email addresses and/or other personal contact information, nor do we participate or tolerate Internet "Spamming" of any nature. The personal information that you provide to MilitaryDate.com will be used solely for the purpose of delivering, promoting and maintaining our service to you.

Termination of Memberships
Users who agree to participate in the services of MilitaryDate.com, may cancel their membership at any time by visiting the Account area and clicking on the link to "Remove Account". This will remove any personal information from the Provider database. This DOES NOT cancel recurring billing to Preferred Membership accounts as set up by a User. In order to terminate recurring billing, a User must follow these instructions:

Login and complete our Preferred Membership Cancellation Form. You must notify us at least one week prior to your scheduled monthly billing date to avoid additional charges. Note, that recurring billing cancellation by a User is not final until you receive a confirmation email from Provider stating so. Once recurring billing has been cancelled on a User account, if the account remains in Provider's system, the User account will be returned to a "non-paying" Registered User status.

Refund Policy
Preferred Memberships are billed on a recurring monthly basis unless cancelled. There are no refunds for partial month Preferred Membership cancellations. All cancellations are handled according to the above Termination policy.

Disclaimer/Release of Liability
User agrees that Provider provides use of its service to User at Users sole risk. User agrees to release Provider, it's agents, servants, employees and/or other representatives from any and all liability and/or damage claims resulting from use of Provider's service. User further agrees to release Provider from any and all claims resulting from the actions of other Users of Provider's service. Where negligence has been deemed by a court of law, User agrees to limit the total aggregate value of any monetary settlements to a value not greater than the total fees paid to Provider for services by the User.

Dispute Resolution
User agrees that any and all civil disputes shall be pursued and resolved via means of legal mediation that will physically convene in New London County in the State of Connecticut, U.S.A., at a location deemed acceptable by Provider.

Revisions to this Agreement
Provider maintains the right to make changes and/or additions to this agreement without notifying the User in writing. Provider will make the latest version of this agreement publicly available to all registered site Users who are logged into their account for their review.
